DEFINITION OF RENTAL PROPERTY BUSINESS: A rental property business is an investment in real estate that involves leasing or renting out a residential or commercial property to tenants. According to the National Association of Realtors, the median investment in rental properties is $150,000. The NAICS code for rental and leasing services is 5322.

TYPES OF OWNERSHIP: A rental property business can be owned by a sole proprietor, partnership, Limited Liability Company (LLC), or corporation. Each type of ownership has its own advantages and disadvantages, but LLCs are often the most popular because they offer liability protection and are taxed as pass-through entities.

BUSINESS LICENSING: All businesses need a business license, including rental property businesses. The license fee can range from $0 to $100 or more depending on the location. The purpose of the license is to ensure safety, nuisance, sanitary, and aesthetic reasons. For example, home-based rental property businesses need to comply with zoning rules like no signs, employees, deliveries, noise, hazard, etc.

In contrast, brick-and-mortar rental property businesses need certificates of occupancy for safety requirements like exit signs, fire extinguishers, fire sprinklers, fire detectors, fire alerts, special trash cans, employee rights posters, emergency exit doors, and signs. SHORT TERM RENTAL REQUIRES CERTIFICATE OF OCCUPANCY PERMIT

To get a short term rental permit, you need to have a Certificate of Occupancy that verifies that your home is safe and home insurance that can cost as much as $150.00 or more per year.

The Certificate of occupancy may take 2 weeks to get, and it may cost as much as $100 to $200 because a home survey by the city or county must take place before issuance. In addition, you need to have a seller's permit to collect sales tax or hotel tax and remit it to the state.

COST OF SHORT RENTAL PERMIT

Keep in mind that it may cost as much as $500 or more to get the short term rental permit after you are approved. That said, keep in mind that as a business, you will need all business registrations like any other business.

SHORT TERM RENTAL AIRBNB BUSINESS LICENSING REQUIREMENTS

So, remember, FIRST file a DBA, LLC, OR corporation because all other licenses and tax registrations are filed under the name of LLC, DBA, or corporation.

Also, to apply for the short-term permit, you need to apply as a business. A business can be a sole proprietor, an LLC or a corporation.
